1. Acceptance of Agreement

By accessing this website, submitting design blueprints, or commissioning cost estimation services, you agree to be bound by these Terms & Conditions. These terms form a legally binding agreement between you (the "Client") and The Estimation Company, a division of the Kadamban Group. If you do not agree to these terms, you must refrain from using our services.

2. Scope of Quantity Surveying Services

The Estimation Company provides pre-construction cost consultancies, material takeoff logs, Bills of Quantities (BOQ) preparation, budget planning sheets, value engineering analysis, and rate compilation support. Our calculations and deliverables are based entirely on the architectural structures, municipal details, layouts, and cost guidelines supplied directly by the Client.

3. Delivery & Timeline Guidelines

We aim to deliver standard material takeoffs and BOQ reports within 48 to 72 hours of project acceptance. However, delivery timelines are advisory estimates and may vary depending on project complexity, file legibility, structural scaling details, or clarification requests. We are not responsible for direct or indirect business impacts resulting from delivery delays.

4. Accuracy Disclaimer & Limitations of Liability

While our engineers aim for a 99%+ accuracy metric utilizing standard measurement standards (including IS 1200 norms):

• Advisory Projections: All delivered takeoffs, rates, material requirements, and budget sheets are professional advisory estimates. Final construction bids, vendor quotes, site labor performance, and procurement prices may change.
• No Budget Liability: We are not liable for direct project budget overruns, builder invoice discrepancies, resource shortfalls, or material surpluses at your active site.
• Pre-Order Verification: The Client is solely responsible for cross-checking and validating all quantity takeoffs with their contracting builders or suppliers before placing bulk purchasing orders.

5. Intellectual Property Rights

All custom BOQ tables, takeoff spreadsheets, cost control reports, and analysis documents generated by our team remain the exclusive intellectual property of The Estimation Company. Upon full payment of the designated service fees, the Client is granted a non-exclusive, royalty-free license to use these deliverables strictly for the specific project site specified in the initial query.

6. Payment Terms & Refund Policy

• Service Fees: Fees for bespoke quantity surveying are estimated based on structural layouts and built-up dimensions, and must be cleared prior to final file download unless agreed otherwise in writing.
• No-Refund Policy: Once our engineering team starts calculating takeoffs and structuring the BOQ based on your design blueprints, service charges are non-refundable.

7. Client Responsibilities

To secure correct results, the Client is responsible for:

• Providing clear, complete, and high-legibility CAD files, structural layouts, and site specifications.
• Promptly answering clarify requests regarding material specifications or design ambiguities.
• Ensuring that they own the copy/usage rights for all design drawings uploaded to our systems.

8. Indemnification

The Client agrees to defend, indemnify, and hold harmless The Estimation Company, the Kadamban Group, and its officers, directors, and consultants against any claims, losses, liabilities, or expenditures (including legal fees) resulting from copyright challenges on uploaded designs, site implementation problems, or errors in contractor procurement choices.

9. Governing Law & Dispute Resolution

These terms and any service engagements are governed by and construed in accordance with the laws of India. Any disputes arising out of these terms shall be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka.
